CDT Joins Amicus Brief Filed by Reporters Committee for Freedom of the Press in Twitter v. Paxton

The Center for Democracy and Technology (CDT) joined an amicus brief filed by the Reporters Committee for Freedom of the Press (RCFP), alongside the Electronic Frontier Foundation, the Media Law Resource Center, and PEN America, in the case Twitter v. Paxton.

Our amicus brief argues that the Texas Attorney General’s efforts to use deceptive trade practices laws to investigate purported “bias” in content moderation violates the First Amendment and could be particularly susceptible to abuse by public officials attempting to suppress political criticism of themselves or others. Any attempt by government to enforce what it deems viewpoint neutrality on a communications platform is a profound threat to First Amendment protections for public discourse and the free flow of information online.
