CDT Issue Brief on Federal Data Breach Notification Legislation

A September 2014 Ponemon study found that 60% of U.S. companies have experienced more than one data breach in the past two years, and that data breaches increased in frequency over the past year. This report underscores the need for stronger laws that mandate both breach notification procedures and measures to avoid breaches before they occur.

We want to be specific about what should (and should not) be a part of federal data breach legislation specifically, and also discuss the elements that should be included in any data breach proposal generally.
