The AI Act promised to uphold fundamental rights and protect against the worst harms and risks of AI. Despite this early ambition, the final text left many unanswered questions for individuals seeking to obtain redress for harms suffered by AI, ultimately failing to provide a clear way forward for affected people to access effective remedies. At a time when EU policymakers, governments and industry actors alike push for the mass adoption and operation of AI, there is renewed urgency for this glaring omission to be rectified. CDT Europe and the Hermes Center have undertaken research to address this gap.
In its soon to be released report “A Long Road Ahead: Effective Remedies for Artificial Intelligence Harms in the European Union”, CDT Europe analyses the role played by other EU legal frameworks in addressing the gaps in the AI Act, their limits in bringing true effective remedies for AI, and the necessary steps to bring access to redress closer to reality. The upcoming report “Ensuring rights in the age of AI”, published by the Hermes Center and The Good Lobby Italia, provides a reasoned and contextualized analysis of the redress mechanisms contained in the AI Act within the Italian legal framework, while also proposing recommendations to the national legislator to ensure they are effective and accessible to citizens.
