At a panel discussion hosted by the Advisory Committee to the Congressional Internet Caucus on Thursday, Emma Llansó, director of the Center for Democracy & Technology’s Free Expression Project, said it’s difficult to write a law that only targets malicious disclosure of information while not also covering a lot of important speech.
There isn’t a silver bullet, she later said.
“But if you try to craft a new crime that is expansively-enough defined to cover every single instance of an exposed photo, we are absolutely going to sweep in other kinds of content, other kinds of expression, and the law is not gonna survive First Amendment scrutiny,” Llansó said.
