CDT Submits Comments to OMB on Federal Agencies’ Use of Commercially Available Information

On December 16, the Center for Democracy & Technology submitted comments to the Office of Management and Budget (OMB) on federal agencies’ use of commercially available information (CAI). Our comments highlight the harms that information obtained from data brokers pose to individuals’ privacy, rights, and safety.

We urge OMB to take additional steps to address the risks associated with such information, including by updating the requirements for Privacy Impact Assessments, maintaining a comprehensive inventory of agencies’ use of CAI, requiring agencies to proactively disclose how CAI is used to make determinations about individuals, and creating a centralized reporting mechanism for agencies to report problems with CAI.
