CDT Joins Amicus Brief on User Empowerment in Zuckerman v. Meta

On Thursday, September 5, 2024, CDT joined an amicus brief led by the ACLU of Northern California and the Electronic Frontier Foundation in support of Professor Ethan Zuckerman’s challenge against Meta. 

The case, litigated by the Knight First Amendment Institute, seeks preemptive protection for Professor Zuckerman to release Unfollow Everything 2.0, a browser extension that would allow users to modify their Facebook newsfeeds and change how they receive information on that platform. 

The brief argues that Section 230’s statutory text, findings, policy statements, and legislative history confirm that Congress conferred immunity for user-empowerment technologies like Unfollow Everything 2.0 and that Section 230 protects users’ rights in the digital age.
