Testimony for the Judicial Conference’s Advisory Committee on Criminal Rules – Rule 41

The Center for Democracy and Technology has submitted its written testimony for the Nov. 5, 2014 hearing of the Judicial Conference’s Advisory Committee on Criminal Rules.

The proposal before the Advisory Committee on Criminal Rules to modify Rule 41 of the FRCrmP has significant implications for open legal and policy issues, as well as broad technological consequences affecting the privacy of computer users worldwide. We believe the Judicial Conference should withdraw the proposed changes to Rule 41 from its rulemaking process, and that the proposal should instead be deliberated in Congress. We’re happy to explain why.
