Ohio v. Sudinia Johnson [amicus brief]

CDT joined the National Association of Criminal Defense Lawyers and others in filing this amicus brief.  The critical question before this Court is whether law enforcement may surreptitiously install a Global Positioning System (“GPS”) tracking device on an individual’s automobile and thereby remotely track and record that individual’s movements, 24 hours a day, for as long as they want, anywhere, without any judicial oversight whatsoever. The decision in this case will have profound consequences for the lives of Ohioans as it will permanently define to what extent citizens of this state must forfeit “any meaningful claim to personal privacy or effectively withdraw from a technologically maturing society.”  In re Application of the United States of America for an Order Authorizing the Release of Historical Cell-Site Information, 736 F. Supp. 2d 578, 596 (E.D.N.Y. 2010).
