Florence v. Shurtleff Final Order

This final order from a Utah district court declares that Internet users cannot be prosecuted for posting constitutionally protected content on generally accessible websites, and are not required by law to label such content.  This order brings to a close long-running litigation by CDT, Media Coalition, and the ACLU of Utah against Utah state “harmful to minors” statutes that threatened adults’ First Amendment right to access lawful content online.  Through this declaratory judgment, the Utah Attorney General agrees that the law will be used to prosecute only those who intentionally send “harmful to minors” material to a specific individual known or believed to be a minor.
