On 18 December, the European Data Protection Board published its opinion on the use of personal data for the development and deployment of artificial intelligence models. The opinion was much anticipated as the interplay between privacy and AI rules raises many questions and crystallizes GDPR interpretation challenges in the face of new technology. This opinion looks at 1) when AI models can be considered anonymous, 2) whether legitimate interest can be used as a legal basis for developing or using AI models, and 3) what happens if an AI model is developed using personal data that was processed illegally.
